Terms and Conditions
§1 Scope & Provider
These Terms and Conditions ("Terms") govern the contractual relationship between Centric Software International Ltd. ("Provider", "we") and the users ("Users", "you") of the application MyTripWallet ("App"), available as an app for iOS as well as a web application.
By installing, accessing, or using the App, you accept these Terms. Additional terms of use of the respective distribution platform (e.g. Apple's App Store or other distribution platforms) also apply; with regard to these platform operators, you are the direct contracting party of the platform in respect of purchase and payment processing, not of the Provider.
Deviating, conflicting, or supplementary terms and conditions of the User do not become part of the contract unless the Provider expressly agrees to their applicability in writing.
§2 Description of Services
MyTripWallet is a digital wallet for managing travel documents, receipts, important links, and to-do lists for one's own trips. The App can generally be used entirely offline and without registration; in this case, all data is initially stored locally on the User's device.
For certain additional features – in particular cross-device cloud synchronization, sharing trips with other users, as well as client management and whitelabel branding – a free or paid user account is required (see §3 and §4).
The Provider strives to continuously develop the App and its features further. There is no entitlement to the permanent availability of specific features, feature scope, or design elements; §10 remains unaffected.
§3 Registration & Conclusion of Contract
The mere use of the App in offline mode without an account does not establish a contractual relationship beyond these Terms in the narrower sense. A user account can be created in the Profile section by providing an email address and password (at least 8 characters).
Upon completion of registration, the User receives a confirmation email; the contract for the use of the user account and the account-bound features (cloud synchronization, sharing, client management) comes into effect upon successful confirmation of the link contained in this email.
The User is obliged to provide truthful information during registration and to keep their access credentials (in particular password and, if applicable, the PIN code set up) confidential. Use is equally permitted for consumers and business users; Enterprise features (client management, whitelabel branding) are primarily aimed at commercial users such as travel agencies.
Registration requires the User to have reached the age of 16 or to have obtained the corresponding consent of a legal guardian.
§4 Memberships, Prices & Payment
MyTripWallet is offered in three membership tiers:
| Feature | Basic | Premium | Enterprise |
|---|---|---|---|
| Price | free | one-time purchase | monthly subscription |
| Advertising | yes | no | no |
| Active trips | max. 3 | unlimited | unlimited |
| Entries per type & trip | max. 2 | unlimited | unlimited |
| Cloud synchronization | – | ✓ | ✓ |
| Sharing trips | – | ✓ | ✓ |
| Client management & whitelabel | – | – | ✓ |
The Basic version can be used free of charge on a permanent basis, but may contain advertising and is subject to the quantity restrictions set out in §2.
Premium is a one-time purchase ("Lifetime") that permanently unlocks the corresponding features without recurring payments. Enterprise is a monthly paid subscription that includes all Premium features.
Processing via App Store / Payment Service Provider
Purchases and subscriptions are processed exclusively via the respective app store (e.g. Apple App Store) or the payment service provider integrated into the web version. The prices applicable there (including statutory VAT), payment terms, and cancellation/withdrawal rules of the respective store operator also apply in addition. The Provider has no influence on the specific payment processing carried out by the store operator.
Enterprise subscriptions automatically renew for a further month each unless cancelled before the end of the current billing period via the settings of the respective app store. Cancellation is carried out exclusively via the account management of the store operator (e.g. Apple ID settings), not within the App itself.
If a membership has already been purchased but is not available on a new device, it can be reactivated via the "Restore Purchase" function in the profile section, provided it is linked to the same store account.
§5 Term, Termination & Withdrawal
The free user account (Basic) runs for an indefinite period and can be terminated by the User at any time via the "Delete Account" function in the profile section (see §12).
The Enterprise subscription runs until further notice and renews automatically unless cancelled in good time before the end of the respective billing period via the app store. The Premium one-time purchase is unlimited in time and does not require cancellation.
Right of Withdrawal for Digital Content
Consumers are generally entitled to a statutory right of withdrawal. For in-app purchases and subscriptions made via app stores, the exercise of the right of withdrawal is governed by the terms of the respective store operator. The right of withdrawal expires prematurely if the User has expressly agreed to the immediate performance of the contract before expiry of the withdrawal period and has confirmed thereby that they lose their right of withdrawal as a result (e.g. through the immediate unlocking of premium content after purchase).
§6 Obligations of the User
The User undertakes to
- use the App only within the framework of applicable laws and not to post or send, via the sharing function, any unlawful, offensive content or content that infringes the rights of third parties (e.g. documents, links, notes),
- treat their access credentials confidentially and not grant third parties access to their account,
- when using client management (Enterprise), process the data of their own clients only on a suitable legal basis (in particular in accordance with the GDPR) – the User acts as the data controller vis-à-vis their own clients in this regard, while the Provider merely provides the technical infrastructure,
- refrain from taking any measures that could impair the operation of the App or the associated server infrastructure (e.g. automated mass queries, reverse engineering beyond the legally permitted extent).
In the event of violations of these obligations, the Provider may restrict access to account-bound features or block the account after prior warning (see §12).
§7 Sharing Trips & Client Management
Users at the Premium and Enterprise tier can share trips with other people and send the generated PDF trip plan ("Itinerary") by email. The sharing User warrants that they are entitled to share the content contained in the trip with the recipients specified by them.
For shared trips, changes are visible to all participants and are synchronized automatically; a shared trip can only be deleted after all shares have been revoked.
Enterprise users can record their own client data (name, email) as part of client management, including by importing from the address book of the end device, and add their own logo, name, and an accent color to the PDF trip plan ("Whitelabel"). In this context, the Provider is solely responsible for the technical provision; the Enterprise User themselves is responsible for the accuracy and lawfulness of the recorded client data as well as for any consent required from the respective clients.
§8 Data, Content & Storage
The User remains the owner of the content they have posted (documents, photos, receipts, links, to-dos, client data). Without an active user account, this content is stored exclusively locally on the end device; in this case the Provider has no access to it.
With an active Premium or Enterprise account, the content is additionally synchronized in encrypted form with the Provider's server in order to enable cross-device use and the sharing of trips. Further details on the nature, scope, and purpose of the data processing as well as the rights of Users are governed by the separate Privacy Policy, which is also accessible via the "Legal" section in the profile.
The User is themselves responsible for additionally backing up important content (e.g. via the "Share Itinerary" function as a PDF export), in particular before switching devices, deleting their account, or irrevocably deleting a trip.
§9 Rights of Use & Intellectual Property
All rights to the App itself, in particular software, design, logos, and trademarks of MyTripWallet, belong to the Provider or its licensors. The User is granted a simple, non-transferable, non-sublicensable right to use the App within the framework of these Terms for private purposes or – in the case of Enterprise use – for their own business purposes.
For logos and content uploaded by the User as part of Whitelabel branding, the User warrants that they hold the necessary rights thereto and grants the Provider the right of use necessary for generating the respective PDF trip plan.
§10 Availability & Changes to the App
The Provider strives to ensure a high level of availability of the account-bound features (in particular cloud synchronization) but cannot guarantee uninterrupted availability. Maintenance work, technical faults, or events outside the Provider's sphere of influence (force majeure, failures of third parties such as app store or hosting providers) may lead to temporary restrictions.
The Provider reserves the right to adjust, expand, or discontinue individual features of the App as part of its ongoing development, provided this is reasonable taking into account the legitimate interests of the User. Significant restrictions affecting the core of the respective membership for already paying Users will, where possible, be announced with reasonable advance notice.
§11 Liability
The Provider is liable without limitation for intent and gross negligence, as well as under the provisions of the Product Liability Act, for injury to life, body, or health, and within the scope of any guarantees assumed.
In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfillment of which enables the proper performance of the contract in the first place and on the observance of which the User may regularly rely, the Provider's liability is limited in amount to the foreseeable damage typical for the type of contract at the time the contract was concluded. In all other respects, liability for slightly negligent breaches of duty is excluded.
The above limitations of liability also apply for the benefit of the Provider's legal representatives and vicarious agents if claims are asserted directly against them.
No Substitute for Travel Bookings
MyTripWallet serves exclusively to manage and store travel documents. The Provider is not a contracting party of the underlying travel services (flights, hotels, rental cars, etc.) and gives no warranty as to the accuracy, completeness, or validity of data entered by the User or extracted via AI text recognition (e.g. amounts, dates). The User is obliged to check all automatically recognized information before use.
§12 Blocking & Account Deletion
The User can irrevocably delete their account at any time via the "Delete Account" function in the profile section. In doing so, all trips, clients, and data stored locally on the device, as well as – if an account exists – the associated server-side stored data, are deleted or deactivated. This action cannot be undone; the User should, if applicable, create a backup beforehand via "Share Itinerary".
The Provider is entitled to block or terminate a user account in the event of a serious or repeated violation of these Terms (see §6) after prior warning with reasonable notice. Fees already paid for periods of service not yet rendered will be refunded on a pro rata basis in this case, unless otherwise provided by law.
A Premium one-time purchase already acquired remains unaffected by the User's deletion of their account, provided it is linked to the same store account via the purchase restoration mechanism of the respective app store.
§13 Amendment of these Terms
The Provider reserves the right to amend these Terms with effect for the future, insofar as this is necessary for legal reasons, due to changes in the App's functionality, or to adapt to changed technical or economic conditions, and does not unreasonably disadvantage the User. The User will be informed of significant changes in the App or by email with reasonable advance notice.
If the User does not object to the amended Terms within six weeks of receiving the notice of amendment, or continues to use account-bound features of the App after expiry of this period, the amended Terms shall be deemed accepted. The Provider will separately draw the User's attention to this legal consequence and their right of objection in the notice of amendment.
§14 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the User is a consumer, this shall apply only to the extent that it does not restrict the protection afforded by mandatory consumer protection provisions of their place of habitual residence.
If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract shall be the Provider's registered office, insofar as legally permissible.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
The European Commission provides a platform for online dispute resolution (ODR), accessible at ec.europa.eu/consumers/odr. The Provider is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
