§1 Scope & provider

These Terms and Conditions (“Terms”) govern the contractual relationship between Centric Software International Ltd. (“provider”, “we”) and the users (“user”, “you”) of the service MyTripWallet, available at mytripwallet.app and as an app for iOS.

By using the service you accept these Terms. If the app is obtained through a distribution platform (e.g. the Apple App Store), that platform's terms apply in addition; with regard to obtaining the app you are a direct contractual partner of the platform.

Deviating, conflicting or supplementary terms of the user do not become part of the contract unless the provider expressly agrees to them in writing.

§2 Description of the service

MyTripWallet keeps the documents of a trip in one place. A trip holds tickets, bookings, receipts, links and tasks; every entry can carry a date, a note and an attachment.

The scope also includes:

  • receipt recognition (OCR) that suggests amount and date from a photographed receipt — recognition runs on the device,
  • an itinerary as a PDF generated from the entries of a trip,
  • sharing a trip with other accounts,
  • a PIN lock for the app, a widget and a share extension for iOS,
  • push messages about dates and shared trips,
  • syncing the data with the server from the Premium tier upwards.

The provider develops the service continuously. There is no entitlement to the permanent availability of individual features or design elements.

§3 Use without an account, account & conclusion of contract

Basic use requires no account. Trips, entries and attachments can be created and used as long as they remain on the device only.

An account is needed for syncing between several devices, for sharing trips and for the backup on the server. It is created with an e-mail address and a password; by submitting the registration form the user makes an offer to conclude a free user contract, and the contract comes into effect when the account is activated.

The account is valid for MyTripWallet only. Other applications of the provider maintain separate accounts with their own credentials, even if the same e-mail address is used.

Account details must be accurate, credentials must be kept confidential, and an account is not transferable. Use requires the user to be at least 16 years old or to have the consent of a legal guardian.

§4 Tiers, prices & payment

MyTripWallet is offered in five tiers. All prices are final prices including statutory VAT where applicable; the prices shown in the app and in the App Store before purchase are the ones that apply.

Premium is a one-off payment and remains valid permanently. Premium Plus, Enterprise and Whitelabel are monthly subscriptions; each tier includes the scope of the ones below it.

Reaching a limit

When a quantity limit is reached, existing trips and entries remain fully usable. Only the creation of further units is blocked until a higher tier is chosen or existing units are deleted.

Payment processing

Purchases and subscriptions are processed through the Apple App Store; Apple's terms apply in addition and Apple is the contractual partner for payment processing. A subscription renews automatically for the period chosen unless it is cancelled at least 24 hours before it ends in the settings of the App Store account.

A purchased scope is tied to the App Store account, not to the MyTripWallet account. After changing device, the “restore purchase” function brings it back.

§5 Term, cancellation & withdrawal

The free user contract runs for an indefinite period and can be terminated by either side at any time without notice. The user terminates by deleting their account in the app.

For subscriptions the cancellation routes of the App Store apply. Once the paid period ends, the Basic tier and its limits apply again; trips already created are kept — until the stock is back below the limit, new ones simply cannot be created.

Right of withdrawal for digital content

Consumers have a statutory right of withdrawal. It expires prematurely if the user has expressly consented to immediate performance and confirmed that they thereby lose the right of withdrawal — for instance by the immediate activation of the higher tier after purchase. Refunds are handled according to the provisions of the App Store.

§6 Obligations of the user

The user undertakes

  • to use the service only within applicable law and not to enter or send any unlawful, offensive or third-party-rights-infringing content (for example in trip names, notes, tasks or uploaded documents),
  • to keep credentials confidential and not to grant third parties access to the account,
  • to process personal data of third parties stored in the service only on an appropriate legal basis,
  • not to take any measures that may impair the operation of the service or its server infrastructure (for example automated bulk requests or reverse engineering beyond what is legally permitted).

In the event of breaches, the provider may restrict access or, after prior warning, suspend the account.

§7 Sharing trips & client management

From the Premium tier upwards the user can share a trip with other accounts. The invited accounts see the entries and attachments of that trip and can edit them depending on the role assigned. The user decides whom to invite and can revoke a share at any time.

The user warrants that they are entitled to pass on the shared content. If a trip contains personal data of third parties — fellow travellers, for instance — the user is responsible for its processing.

From the Premium Plus tier upwards, travel agencies can create clients and manage trips for them. In data protection terms the user is the controller for their clients' data and the provider is the processor, merely supplying the technical infrastructure. A data processing agreement pursuant to Art. 28 GDPR is available from the provider on request.

§8 Data, content & storage

The user remains the owner of the content they enter (trips, entries, documents, receipts, tasks). The provider acquires no rights in it beyond what is technically necessary for operation, display, backup, syncing and delivery.

Without an account all data resides exclusively on the device (IndexedDB). With an account and from the Premium tier upwards it is transferred encrypted and stored on the server in a directory assigned to the account, so that it is available again on another device or after a reinstallation. Details are set out in the privacy policy.

Receipt recognition (OCR) and the generation of the itinerary PDF run on the device; no content is transferred to the provider or to third parties for this. Passing on a finished PDF is initiated by the user.

MyTripWallet is not an archiving system. The user is responsible for retaining receipts of tax or legal relevance; important documents should also be backed up outside the app.

§9 Advertising

In the free tier the iOS app displays an advertising banner delivered through Google AdMob. From the first paid tier onwards it disappears permanently. The respective advertisers are responsible for the content and lawfulness of the advertising shown. Which data is processed in the course of this is set out in the privacy policy.

§10 Rights of use & intellectual property

All rights in the service itself, in particular software, design, logos and the MyTripWallet brand, belong to the provider or its licensors. The user is granted a simple, non-transferable and non-sublicensable right to use the service for their own private or business purposes within the scope of these Terms.

The provider acquires no rights in content entered by the user beyond what is technically necessary to operate, display, back up and deliver the service.

Reverse engineering, removing notices of rights and distributing modified versions are prohibited unless permitted by law.

§11 Availability & changes

The provider endeavours to ensure high availability of the service but cannot guarantee uninterrupted availability. Maintenance work, technical faults or events beyond the provider's control (force majeure, failures of third parties such as hosting or payment providers) may lead to temporary restrictions. No availability commitment in the form of a service level agreement exists.

The provider reserves the right to adapt or extend the range of features in the course of further development, or to discontinue individual features, provided this is reasonable considering the legitimate interests of the user. Substantial restrictions affecting the core of a paid service will, as far as possible, be announced to paying users with reasonable notice.

§12 Liability

The provider is liable without limitation for intent and gross negligence, under product liability law, for injury to life, body or health, and within the scope of guarantees given.

In the event of slightly negligent breach of a material contractual obligation (cardinal obligation) whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely, liability is limited in amount to the foreseeable damage typical for this type of contract. Otherwise liability for slightly negligent breaches of duty is excluded.

The above limitations of liability also apply in favour of the provider's legal representatives and vicarious agents where claims are asserted directly against them.

For loss of data the provider is liable only to the extent that would have arisen had the user carried out proper and regular data backups.

No travel agency, no substitute for original documents

MyTripWallet manages the documents of a trip but does not itself arrange flights, accommodation, hire cars or any other travel services, and is neither a travel agent nor a tour operator. Contracts for travel services are concluded exclusively with the respective provider.

The app is no substitute for original documents. Whether a stored ticket, booking or identity document is accepted during a check, at a border crossing or at check-in is decided solely by the body carrying out the check. No warranty is given for dates, reminders and times in the app; the details provided by the respective provider prevail. Important documents should also be available outside the app.

§13 Suspension & account deletion

The user can irrevocably delete their account in the app at any time. In doing so all trips, documents, receipts, tasks and account data are removed from the server and the account is deactivated. This action cannot be undone; a backup of important content should be created beforehand.

Deletion affects the account for MyTripWallet only. The user's accounts with other applications of the provider remain unaffected and must be deleted there separately.

The provider is entitled to suspend or terminate an account in the event of a serious or repeated breach of these Terms after prior warning with a reasonable deadline. Fees already paid for service periods not yet rendered will in that case be refunded pro rata unless the law provides otherwise.

§14 Changes to these terms

The provider reserves the right to amend these Terms with effect for the future where this is necessary for legal reasons, because of changes to the service, or to adapt to changed technical or economic conditions, and where this does not unreasonably disadvantage the user. Users will be informed of substantial changes in the application or by e-mail with reasonable notice.

If the user does not object to the amended Terms within six weeks of receiving the notice of change, or continues to use the service after that period, the amended Terms are deemed accepted. The provider will separately point out this consequence and the right to object in the notice of change.

§15 Final provisions

English law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a consumer, this applies only to the extent that it does not restrict the protection of mandatory consumer protection provisions of their habitual residence.

If the user is a merchant, a legal entity under public law or a special fund under public law, the registered office of the provider in London, England is — as far as legally permissible — the exclusive place of jurisdiction for all disputes arising out of or in connection with this contract.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory rule takes the place of the invalid provision.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. The provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
